Medical Marijuana Advocates Threaten to Sue
Recent city abatement actions unlawfully preempt Los Angeles dispensary ordinance

LOS ANGELES — Medical marijuana advocacy group Americans for Safe Access (ASA) responded today to the Los Angeles City Attorney’s latest effort to shut down registered dispensaries by threatening to join the recently filed lawsuits against Organica and Holistic Caregivers. Los Angeles City Attorney Carmen Trutanich has taken preemptive enforcement action before dispensaries have a chance to comply with the recently adopted regulatory ordinance, which took more than 2 years to pass.

“It’s clear that the City Attorney is attempting to intimidate and close dispensaries before the Los Angeles ordinance even goes into effect,” said ASA Chief Counsel Joe Elford, who wrote a letter to the City Attorney and District Attorney threatening to join the lawsuits on behalf of patients if they aren’t immediately withdrawn. “The Los Angeles City Attorney and District Attorney’s contempt for the City Council and its recently adopted ordinance is unacceptable and must be stopped.”

On February 18th, the same day a multi-agency law enforcement raid took place at a registered medical marijuana dispensary, City Attorney Trutanich sent at least 18 “eviction letters” to landlords of city dispensaries and filed three “nuisance and narcotic abatement” lawsuits against two dispensary operators, claiming that sales are illegal. With less than one month left before the Los Angeles dispensary ordinance goes into effect, advocates are calling the actions deplorable.

Last October, Trutanich and District Attorney Steve Cooley both attended a symposium on “The Eradication of Medical Marijuana Dispensaries in the City of Los Angeles and Los Angeles County,” hosted by the California Narcotics Officers’ Association (CNOA), a staunch opponent of medical marijuana. Soon after, during City Council deliberations on an ordinance to regulate dispensaries, Cooley commented in a November 18th interview on Public Radio’s AirTalk that the Council’s actions to legalize medical marijuana sales were “irrelevant, meaningless, and…reckless,” and his office would “enforce the laws of the State of California, despite what the City Council [does].” In addition, City Attorney Trutanich commented in a January AirTalk interview that, “sales are illegal under state law.”

Advocates argue that the actions of the City Attorney and District Attorney not only amount to entrapment, but they also violate state law. “It goes without saying that dispensaries deserve the due process right to comply with the city’s ordinance regulating them,” continued Elford. “But, worse than that, the City Attorney’s legal arguments are horribly flawed and have no basis in law.” The City Attorney’s lead cause of action in its litigation to shut down registered dispensaries is based on a nuisance statute that the legislature exempted in SB 420, the Medical Marijuana Program Act of 2003. (See Health & Safety Code Section 11362.775.) The City Attorney also relies on the argument that medical marijuana “sales” are illegal under state law, something refuted by the legislature, the courts, and the State Attorney General.

In November, after ASA threatened to sue Los Angeles if the city outlawed medical marijuana sales, a compromise was thought to have been reached between the Council and the City Attorney. However, public statements and recent enforcement actions throw into doubt whether the City Attorney and District Attorney ever planned on honoring the regulatory ordinance. If the City Attorney refuses to withdraw the lawsuits and recant the eviction letters, ASA will challenge the lawsuits as an intervening defendant, representing the interests of medical marijuana patients.

It supposedly gives you the same high as marijuana and was legally available for purchase for $15 a bag at shops in Lawrence.

Of course, the cops don’t like it. And legislators want to ban it.

But in all this fuss, no one has actually said whether K2 gets you high.

The answer is important because (a) if it doesn’t get you stoned, lawmakers have better things to do than pass unnecessary laws to curry political points and (b) you have better things to do than drive around searching for barely legal faux-reefer if it doesn’t work.

So in the interest of investigating political intent and protecting consumers, the Pitch Action News Team took a day trip to the Sacred Journey — a Lawrence botanical store — bought two bags of K2 and smoked up in the parking lot like a bunch of high school kids getting stoned before first bell.

I’ll be protecting the identity of our testers, given the nature of drug hysteria in this country and the long memory of the Internet. I’ve included their frequency of marijuana use, if any. As for me, yes, I smoked K2, and I’ll tag my own thoughts at the end. I consider this a self-inoculation in case getting a job in a PR firm ever does somehow seem like a good idea.

Because K2 is sold in different flavors, grades and prices, and because we wanted to be thorough, we got two different kinds each sold in 3-gram bags. One was the Standard, which cost $15. The other, Blonde, was a citrus blend and cost twice as much as the Standard. K2 looks like potpourri stomped to dust and mixed with confetti, and it smells about the same. We chose the reliable, available-at-every-gas-station Zig Zag rolling papers as our method of conveyence. All we wanted to know was this: “Does K2 really get you high like marijuana does?”

Again — this is legal.

feel some visual effects (things appeared bright, slightly blurry) and a relaxed physical state. I thought the Blonde was more smooth on the lungs and tasted better. I would use K2 if I only had access to low-grade marijuana. For a small amount of money more, one could buy some decent nuggets. I didn’t feel any lasting side effects after the two times I sampled the K2.”

From an occasional smoker: “Makes me super nauseous. Need to lie down … ”

From a moderate: “As a sometimes-to-moderate pot smoker, I think K2’s high is pretty comparable to the buzz you get from smoking a oney of middies. We smoked two joints. It smelled like herbal, nonclove cigarettes and made my lips tingle slightly. When the high set in, the world seemed to tick a bit slower, and, shit, if everything wasn’t funny as hell … for like five minutes. After that the high creeps off for another 20 or so minutes until it leaves your senses a bit dull, but definitely not too much to talk to police or your boss. Stuff brings on cottonmouth, ‘high thoughts,’ but no apparent eye redness or lasting burnt-ness. Best part: you know it’s not blood pot from a Mexican drug cartel, like most of the brick-weed up in this city. I’ll definitely smoke it again.”

From someone who doesn’t like pot anyway: “My thoughts: K2 made me feel just as uncomfortable and self-conscious as actual marijuana. This is coming from someone who hates smoking weed, so it’s actually a positive review. Two thumbs up!”

We had one more tester, who left to get a soda five minutes into the experiment, never returned, and forgot to send me a review.

Personally, it’s been a long time since I thought it was in society’s best interest for me to smoke a joint and calm the hell down. So I’m not much of an authority anymore. I stopped smoking because I started to get paranoid about adult responsibilities. Smoking pot is no fun if you’re just going to obsessively check your credit score and pay bills at 3 a.m.

That said, I agree with our first reviewer that Blonde is a lot smoother on your lungs. The Standard is rough, and the next morning I coughed up a nice ball of brown stuff.

Regarding the effects: I had a great time. For some reason, everything struck me as hilarious for about 30 minutes. Perhaps it’s because I was the person in the group who smoked most rarely, aside from the one who outright hated pot.

I didn’t feel any of the paranoia I used to associate with marijuana. There’s also a very steep drop once the chemicals have done their job. You look up and you’re dead sober; this is unlike weed, which always left me lethargic and stupid for an hour or two after smoking. This is the kind of thing you could do on your lunch break and be back to work on time and clear-eyed.

One of our testers noted the clear conscience you can have knowing this stuff wasn’t connected to the criminal drug trade, but there’s also peace of mind in knowing you can smoke this stuff walking around downtown without attracting attention. It smells closer to a clove cigarette than anything resembling marijuana. And if you make it right, it looks like you’re rolling your own cigarettes. Which I suppose you essentially are since K2 is still legal.

If they wanted to make medical marijuana legal (AARP members overwhelmingly support that, by the way) and ban this, it’d be a worthy trade. But that’s unlikely to happen anytime soon. Because the effects are so short-lived and so minor compared to how I feel come 2 a.m. in my favorite bar, it seems equally silly for legislators to make this a priority or huff and puff about keeping legal.

Get it while you can. But if K2 is banned before you get a bag, you didn’t miss much.

Feb. 18, 2010 — Marijuana can be a promising treatment for some specific, pain-related medical conditions, according to California researchers who presented an update of their findings Wednesday to the California Legislature and also released them to the public.

”I think the evidence is getting better and better that marijuana, or the constituents of cannabis, are useful at least in the adjunctive treatment of neuropathy,” Igor Grant, MD, executive vice-chairman of the department of psychiatry at the University of California San Diego School of Medicine and director of the Center for Medicinal Cannabis Research at the University of California, tells WebMD.

”We don’t know if it’s a front-line treatment. I’m hoping the results of our studies will prompt larger-scale studies that involve a much more varied population.”

”This [report given to the Legislature] sets the stage of larger-scale studies,” he says.

Some experts who reviewed the report say some of the studies are flawed and that they worry about the long-term health effects of marijuana smoke.

Perspective: Medical Marijuana Research

Some observers speculated that the researchers presented their report to the Legislature to call attention to marijuana research because an initiative to legalize marijuana for general use is expected to be on the California ballot in November 2010.

But Grant says that’s not the case. “We sent it to the Legislature because our report was due,” he says.

The program Grant directs was launched in 1999, when the California Legislature passed (and the governor signed) SB 847. Since then, the center has completed five scientific trials, with more in progress.

Medical Marijuana: The Research Scorecard

Five studies, published in peer-reviewed medical journals, show the value of marijuana for pain-related conditions, the researchers say in the report.

• Smoked cannabis reduced pain in HIV patients. In one study, 50 patients assigned either to cannabis or placebo finished the study. Although 52% of those who smoked marijuana had a 30% or more reduction in pain intensity, just 24% of those in the placebo group did. The study is published in the journal Neurology. In another study, 28 HIV patients were assigned to either marijuana or placebo — and 46% of pot smokers compared to 18% of the placebo group reported 30% or more pain relief. That study is in Neuropsychopharmacology.
• Marijuana helped reduce pain in people suffering spinal cord injury and other conditions. In this study, 38 patients smoked either high-dose or low-dose marijuana; 32 finished all three sessions. Both doses reduced neuropathic pain from different causes. Results appear in the Journal of Pain.
• Medium doses of marijuana can reduce pain perception, another study found. Fifteen healthy volunteers smoked a low, medium, or high dose of marijuana to see if it could counteract the pain produced by an injection of capsaicin, the ”hot” ingredient in chili peppers. The higher the dose, the greater the pain relief. The study was published in Anesthesiology.
• Vaporized marijuana can be safe, other research found. In this study, 14 volunteers were assigned to get low, medium, or high doses of pot, either smoked or by vaporization delivery, on six different occasions. The vaporized method was found safe; patients preferred it to smoking. The study is in Clinical Pharmacology & Therapeutics.

A sixth study, as yet unpublished, found marijuana better than placebo cigarettes in reducing the spasticity associated with multiple sclerosis and the pain associated with the spasticity.

Medical Marijuana Research: What’s Next?

Grant’s researchers will finish two more studies, with results expected by 2011, he says. What happens then, when the initial allocation of nearly $8.7 million, awarded back in 2000, runs out?

“We’re going to act as a kind of shell or organizational structure to help investigators apply for funding with the NIH [and others],” he says. Grant says he is expecting no more funding from cash-strapped California.

Although 14 states have legalized medical marijuana, he says, California is the only state that has ‘’stepped up to the plate” to do research.

Medical Marijuana Research: Other Opinions

The California center’s studies are flawed, says Joel Hay, PhD, professor of pharmaceutical economics and policy at the University of Southern California, Los Angeles, and a vocal critic of medical marijuana.

“It’s not medicine,” he says of marijuana. “It would never be approved by the FDA.

”I certainly concede that cannabinoids may have a very valuable medical role,” he says. But the danger is in the smoking of marijuana, he says, citing health effects.

Isolating the active ingredient is a better approach, he says, and has actually already been done. “If you want a cannabionoid, it’s here,” he says, referring to Marinol, available and FDA approved. The active ingredient is THC or tetrahydrocannabinol, the same as found in marijuana.

”Marijuana contains a huge variety of compounds, some of which have not even been thoroughly identified,” Hay tells WebMD. The studies, he says, are all short-term, with small groups.

Another flaw, he says, is that it’s difficult to have a true placebo when studying marijuana. “People know when they are consuming a psychoactive product,” he says.

Another flaw is that patients were allowed to continue on their pain medicine, says Kevin Weissman, PharmD, director of drug information services at Los Angeles County+University of Southern California Medical Center. That may have affected the results.

Grant counters that it was not humane to take patients off pain medicines that were providing any degree of relief.

Like Hay, Weissman says marijuana does have an analgesic effect. But he worries about the long-term effect of marijuana smoke and says research is needed to find a safer delivery system that works, such as vaporization.

In one of the few scientific developments likely to interest both the Governor of North Dakota and Method Man, scientists at the University of Minnesota have identified the genes in cannabis that allow the plant to produce THC. Finding the genes opens the path to either create drug-free hemp plants for industrial purposes, or to develop plants with much higher concentrations of the psychotropic chemical.

Publishing in the Journal of Experimental Botany, the researchers note that they specifically targeted the genes responsible for generating the drug-filled hairs highlighted in many a High Times photo spread. By impairing or encouraging the growth of those hairs, scientists could gain precise control over the level of THC in the crop.

This development has important consequences for both the medicinal and industrial use of hemp.

On the industrial side, states like North Dakota have been looking to change state law to allow them to raise hemp as a cash crop, for oil and rope production. The ability to create hemp that doesn’t contain any banned substances would allow Dakotans to sow the crop without any changes in the law.

On the opposite end of the spectrum, precise control of the doses of THC found in pot could greatly enhance the medicinal marijuana industry. Currently, dosage is controlled through haphazard breeding and selection, not precise measurements as with most other medications.

It should also be noted that THC is not the only psychoactive compound found in marijuana, so more research is needed before the University of Minnesota scientists can completely control the potency of their crops.

Finally, how this new discovery will affect the pizza delivery business remains to be seen.

The hoverboard, in case you are a soulless automaton who never experienced childhood, was a special effect from Back to the Future II that immediately replaced the flying car as the flagship dream of hyper-advanced technology. The hoverboard was the perfect storm of nerd-child fantasies. It had all the appeal of futuristic tech, the dream of pure flight and the raw aesthetic lust of all the best toys.

And, if left alone, that’s all it would ever have been: a fantasy.

Even children, upon coming out of Back to the Future II and immediately miming sweet hoverboard jumps while inexplicably making lightsaber noises for sound effects, knew that it was just a special effect, not real.

Oh, but the next day at school? The next day at school, there was that one kid. That one insecure little dickhead who had to make friends by lying. That sniveling little weasel who had a black belt in karate, who once met Chuck Norris and who had this super-hot girlfriend across town (but she goes to a different school; you wouldn’t know her). The next day, there was that horrid little bastard who first uttered the words “they’re  real, you know. Hoverboards are real.”

The face we all made as soon as we heard that.

And instantly all his previous lies were forgotten.

“What do you mean they’re real?”

“They exist. For real.”

“What? Fuck you. How would you know?”

“My uncle works at Mattel. If you watch carefully in the movie you can even see the logo. They’re who makes it.”

“No way. You’re such a liar. Why hasn’t anybody else seen one?”

“It’s parents. They all say they’re too dangerous, because you can go too fast and hurt yourself.”

…aaaaand that’s where he had you.

Son of a bitch! Of course! It’s the parents! That is exactly the kind of bullshit parents would do, isn’t it? I mean, it’s not like he’s saying he rode one, or hell, that he’s even seen one, because Mattel can’t release them. Nobody gets hoverboards! Fucking parents!

Goddamn you! GODDAMN YOU TO HELL, PARENTS!

And so for, let’s face it, way longer than you should have, you too probably secretly believed that hoverboards were sitting in a warehouse somewhere like at the end of Raiders of the Lost Ark. Forever locked away in a nondescript wooden crate marked “Too Dangerous (For Kids).” A large wooden crate, abandoned and forgotten… that hovered tantalizingly just inches off the ground.

I’m an adult  now (sort of) and somewhere along the line I let go of that hope, but I’ve still held onto the vague sense of disappointment to this day. However, being an adult in the age of technology, there was now something I could do about it. I could now find out exactly how close we are to having real live hoverboards and, more importantly, find out who the motherfucker was that first started the “they’re real, but too dangerous for kids” rumor, and hopefully drag him screaming into Hell with me (I have no illusions about myself; I’m a complete bastard with poor-impulse control. I’m going down there, probably pretty soon, and the best I can hope for is a deserving travel companion).

And you know what? I found him. Quite easily. It was not hard at all to uncover, I’d just never thought to look for the bastard. The guy that first started it all? The insecure little prick who had to lie for attention? I found him.

It’s Robert Zemeckis.

Look at him. Even now trying to lie… about being bald.

That’s right. The director of Back to the Future II.

And no, this is not backhanded blame for some crap like “he popularized too cool a concept.” He actually did it. Every word of that now infamous lie first came from his lips. Apparently tired of being asked how the special effects were done, Michael J. Fox said that Zemeckis started answering those questions with “what do you mean, how did we do it? It’s a real hover-board. It flies. Michael [J. Fox] just practiced a lot.”

And listen, I don’t know about you, but I’m not going to call Michael J. Fox a liar. Michael J. Fox is literally the most lovable man on earth. He is equal parts underdog and superhero. He is the adorable, pixie-like champion of the common man, and he is bravely, humorously facing down one of the worst diseases on the planet. If he ran for president of the American people’s heart, he would win by a landslide. So you know what? I’m going to trust him over Baldy McDickhead up there.

Seriously, who are you going to believe here? Alex P. Keaton, or somebody who looks like the Devil’s accountant?

But you don’t have to trust Michael J. Fox (you monster) because it’s all on tape. During the Making of Back to the Future II Television Special, Robert Zemeckis went on camera and said “Hoverboards have been around for years, but parents’ groups worry that kids will get hurt, so they’ve pressured the toy companies not to put them on the market.” After which, presumably, he ate an entire baby seal whole by unhinging his jaws and horking it down his neckhole with a series of sickening, jerky swallows, like an owl. On that same special, he even paid a special effects crew to have “test footage” made of the actors practicing on “real hoverboards” off set.

Let me put that in a more concise and accurate way: Robert Zemeckis intentionally made a short film entirely out of lies, for no other reason than to crush the spirits of children. Here it is:

Look, I know: “Fake!! photoshop!!1! you can see the pixelz!”

We all know that. Now.

Everybody can easily spot this as bullshit today; when every other image you see is a political figure’s head expertly superimposed onto a penis, you get pretty good at spotting fakes. But in the late 80s, if somebody showed you something like this–the application of  incredibly expensive movie-quality special effects in an off-screen candid setting–you just believed them. You believed them because we goddamn trusted them back then. It was a much more innocent, fluorescent-colored and conspicuously gay time.

So there it is, now you know: Robert Zemeckis is the one responsible. He is the one that stole the hope right out of the screaming bodies of millions of children, because he is a twisted sociopath who feeds on the destruction of joy.

But there is redemption at hand! There are real efforts being made, right now, by people who have somehow hung onto their hope throughout these dark years–never giving up on the dream of bringing into reality what Robert Zemeckis could only mockingly destroy: The dream of a  real live hoverboard.

Here’s one example, the Airboard:

It is a hoverboard, technically, in that it does hover and you stand on it as one could stand on a board. You control it by shifting your weight dramatically in the direction you want to go. There are no brakes, but you can slow yourself down by squatting low until it stops.

You know what advantage the movie hoverboard had over this thing? You didn’t look like a complete tool riding it. You looked fucking awesome, and that is a hard thing to do when you have to poopsquat just to avoid careening into traffic on your giant air hockey puck.

Early 90s German Techno band, or the face of the future?

But all that doesn’t even matter, because the Airboard is not only ridiculously expensive (starting price around $10,000), has an exceedingly short life span and can only navigate on super smooth surfaces to begin with.

But there are other efforts. Here’s the Hoverboard (optimistic name, guys) which is a slightly more literal take on the concept:

Future Horizons, creators of the Hoverboard, seem to have drastically misunderstood the appeal of the movie version, so they just built a hovercraft shaped like a board. And the world collectively sighed, pinched the bridge of their noses, and reluctantly said “good job, guys, that is… that’s just real awesome,” because the world simply couldn’t bear to break their hearts. This is a board that hovers, sure, but just like the Airboard, it only does so on completely smooth surfaces, it runs out of fuel quickly and it looks like a shitty Ukrainian knockoff of Seaspray, the hovercraft Transformer.

Whut? Is good Transforming Person, yes?

You know what else can run only on perfectly smooth surfaces, achieves approximately the same speed but with better maneuverability and takes a very, very long time to run out of juice? A skateboard. That’s the whole point of the Back to the Future hoverboard fantasy: A super-speed skateboard that can go anywhere at high speeds, for long distances, and not spackle the sidewalk with a layer of bloody enamel if you hit a pebble wrong.

And here’s the closest thing we have to that right now, the Scarpar Powerboard:

It has everything great about the hoverboard: It’s super maneuverable, can generate speeds of at least 35 miles per hour (though they happily advertise you can double that), it can traverse any terrain (it even runs over a goddamn log in that video) and on one small tank of gas it can operate for up to 20 miles. There’s just one problem: It doesn’t fucking hover.

Now, admittedly, a skating tank is pretty high on the list of “rad things I would draw on my Trapper Keeper,” but no matter how awesome the Powerboard gets, it’s never going to hit that futuristic milestone of sustained, personally accessible flight.

At least is has the decency to look awesome, though.

But considering that the Scarpar Powerboard, once released, will only cost about $2,000, it may have to do for now. And as soon as it is released (they’re aiming for next year), I believe the only appropriate celebration would be to tie up Robert Zemeckis and drag his screeching demon husk through the woods with it until the fucking thing runs out of gas.

But hey, it’s not like I’m bitter or anything.
